This Privacy Policy describes how GymMap (Sole Proprietorship/Toiminimi) processes the personal data of its mobile application users. We comply with the EU General Data Protection Regulation (GDPR) and national legislation.

2. Data Processed and Purposes of Processing

We process only the data necessary to provide the service in three categories:

A. User Profile and Professional Information

  • Data: Username, email address, age, gender, interests, and professional title (e.g., PT, massage therapist, naprapath, chiropractor, acupuncturist, or other recovery service provider).

  • Purpose: Creating a user account, maintaining the profile, and providing visibility for professionals to reach customers.

  • Legal Basis: Contract (Terms of Service).

B. Activity and Voluntary Location Data (Special Categories of Data)

  • Data: User check-ins at gyms, workout information, and achievements.

  • Purpose: Finding workout partners and displaying activity on the map. Data is visible to other users only for a limited time.

  • Legal Basis: Consent. Since workout data and gym visits can be interpreted as health-related data, we request explicit consent for processing this data when the application is set up.

C. Communication (Chat)

  • Data: Chat messages between users.

  • Purpose: To enable contact between workout partners and professionals. Messages are confidential.

  • Legal Basis: Contract (a core feature of the service).

3. Special Conditions for Professionals

Professionals may use GymMap to market their services under the following conditions:

  • Contractual Obligation with the Gym: The professional (including PT, massage therapist, naprapath, chiropractor, acupuncturist, or other recovery service provider) is personally responsible for ensuring they have the gym owner's permission to offer services and advertise at that location. All commercial terms and permissions are agreed upon directly between the professional and the gym.

  • Restriction: Professionals agree not to post notices at gyms that have their own staff offering similar services, unless otherwise agreed with the gym operator.

  • Use of Data: Professional information is used only for internal mediation within the service. GymMap does not act as a payment processor; all financial transactions occur directly between the professional and the customer outside the application.

4. Retention Period and Data Security

  • Retention: We store data as long as the user account is active.

  • Location Data: User check-ins at a gym are visible on the map only temporarily.

  • Deletion: Users can delete their account in the app settings, upon which all profile data and messages are permanently deleted, unless retention is required by law.

  • Protection: Data is stored on secure servers in the Nordic countries. We do not use external analytics tools or track users outside the application.

5. Disclosure of Data

  • We do not sell or disclose personal data to third parties for marketing purposes.

  • Certain data (such as username and check-in location) is public to other users of the application in accordance with the nature of the service.

6. User Rights

You have rights under the GDPR: right of access, right to rectification, right to erasure (right to be forgotten), withdrawal of consent, and the right to lodge a complaint with a supervisory authority.

TERMS OF SERVICE: GymMap

By accepting these Terms of Service, you agree to comply with them when using the GymMap application (hereinafter referred to as the "Service").

1. Description of the Service

GymMap is a community and digital platform designed to help users find workout partners, fitness facilities, and sports and wellness professionals (such as Personal Trainers, massage therapists, naprapaths, and chiropractors).

2. User Obligations and Content Appropriateness

The user is responsible for the accuracy of the information provided in their profile.

The Service's chat function is intended for appropriate and sports-related communication. Harassment, inappropriate language, or offensive content will lead to immediate account termination.

Users are solely responsible for their own safety when arranging meetings with other users.

3. Professionals and Marketing

Professional services (e.g., Personal Trainer, massage therapist, naprapath, chiropractor, acupuncture, or other recovery-related services) may be advertised within the application under the following conditions:

Authorization to Operate on Gym Premises:

The professional (e.g., PT, therapist, or equivalent) is strictly obligated to obtain permission from the gym owner or operator to offer their services and post notices at that specific location. The service provider and the gym shall independently agree upon terms, potential commissions, or other cooperation models. GymMap is not a party to these agreements.

Non-Compete and Unauthorized Marketing:

Professionals may not post notices or market their services at gyms or fitness centers that have their own staff offering similar services, unless the professional has explicit permission from the gym management.

Limitation of Liability:

GymMap acts only as a digital platform for creating contacts. GymMap is not a party to the contract between the professional and the customer and is not responsible for payments, cancellations, service quality, or contractual negotiations between the professional and the gym.

Breach of Contract:

Violation of this section or unauthorized activity on gym premises may lead to the immediate deletion of the user account without prior warning.

4. Location Notifications (Check-ins)

The user understands that by posting a notification of their presence at a gym, their profile/username will become visible to other users at that location on the map.

Notifications are voluntary and are intended solely for finding workout partners or services.

5. Intellectual Property Rights

All rights to the application's name, logo, and technical implementation belong to GymMap. The user retains rights to their own content (profile pictures, etc.) but grants GymMap the right to display them to other users of the application.

6. Limitation of Liability

The Service is provided "as is." GymMap is not responsible for any technical malfunctions in the application, disputes between users, or disputes between service providers and gyms.

7. Account Deletion

Users have the right to delete their account at any time. GymMap reserves the right to delete any user who violates these Terms of Service, gym rules, or the law.
